Deputy Speaker And Speaker Pro Tem Of Lok Sabha
Deputy Speaker of Lok Sabha
The Deputy Speaker, like the Speaker, is chosen by the Lok Sabha from among its members. He is elected after the Speaker of the House has been elected. The Speaker sets the date for the Deputy Speaker's election. When the position of Deputy Speaker becomes empty, the Lok Sabha elects a new member to fill it.
Powers and Functions of Deputy Speaker of Lok Sabha?
The Deputy Speaker, like the Speaker, normally serves for the duration of the Lok Sabha. In any of the three conditions listed below, he may quit his office sooner: If he no longer serves in the Lok Sabha; If he writes to the Speaker to resign; and If he is removed from office by a resolution passed by a majority of the Lok Sabha members. Only 14 days' notice is required for such a resolution to be moved.
When the Speaker's office is vacant, the Deputy Speaker assumes responsibility. When the Speaker is unable to attend a House meeting, he fills in for him. In all circumstances, he assumes all of the Speaker's authority. In the event that the Speaker is unavailable, he preside over a combined sitting of both Houses of Parliament.
It is important to clarify that the Deputy Speaker is not the Speaker's subordinate. He has direct accountability to the House. The Deputy Speaker has one specific privilege: whenever he is appointed to a legislative committee, he becomes its chairman automatically.
While presiding over the House, the Deputy Speaker, like the Speaker, is unable to vote in the first instance; he can only cast a tie-breaking vote. Furthermore, if the House is considering a resolution to remove the Deputy Speaker, he is not permitted to preside over the meeting, even if he is present.
When the Speaker is in charge of the House, the Deputy Speaker acts in the same way as any other member of the House. He has the right to speak in the House, participate in its procedures, and vote on any issue that comes before it. The Deputy Speaker is entitled to a regular salary and stipend set by Parliament and paid from the Indian Consolidated Fund.
Both the Speaker and the Deputy Speaker were normally from the ruling party until the 10th Lok Sabha. Since the 11th Lok Sabha, it has been agreed that the Speaker will come from the ruling party (or ruling alliance), while the Deputy Speaker will come from the largest opposition party. The Speaker and Deputy Speaker do not take and sign any separate oaths or affirmations when they take office.
What is Panel of Chairpersons of Lok Sabha?
According to Lok Sabha rules, the Speaker appoints a panel of no more than 10 chairpersons from among the members. In the absence of the Speaker or the Deputy Speaker, any of them can preside over the House. When presiding, he has the same powers as the Speaker. He will remain in office until a new panel of chairpersons is elected. When a member of the panel of chairpersons is also absent, the Speaker is replaced by a person chosen by the House.
It is important to note that when the Speaker or Deputy Speaker's position is vacant, a member of the panel of chairpersons cannot preside over the House. During this period, the Speaker's duties are to be carried out by a member of the House appointed by the President. To fill the vacated positions, elections are held as quickly as practicable.
What do you Mean by Speaker Pro Tem?
The Speaker of the previous Lok Sabha vacates his position shortly before the first sitting of the newly-elected Lok Sabha, as required by the Constitution. As a result, the President designates a LokSabha member as Speaker Pro Tem. Typically, the most senior member is chosen for this. The Speaker Pro Tem is sworn in by the President personally. The Speaker Pro Tem possesses all of the Speaker's powers. He preside over the newly-elected Lok Sabha's maiden session. His primary responsibility is to deliver the oath to new members. He also makes it possible for the House to elect a new Speaker. When the House elects a new Speaker, the Speaker Pro Tem's position is abolished. As a result, this office is just temporary, lasting only a few days.
